The Curious Case of Suo Moto Notice of Ms. Odho’s Wine Bottles

Any reasonable person will not disagree, that if Ms. Odho was violating any law by carrying two wine bottles in her luggage, from Islamabad to Karachi on a PIA flight, she is answerable. If there is a law that requires her to declare the spirits she is carrying, with her on a domestic flight, then it should be enforced.

There is no question that Ms. Odho is a frequent traveler and more than likely familiar with the laws of carrying the spirits on an aircraft. If media reports are true and she has resigned from the post of the Vice President of APML, then there is some truth to the matter.
Those who are being critical of her carrying bottles of wine in an “Islami country”, ought to get a life. Agreed that her conduct does not sit well with her political persona. Especially when former President Musharraf’s party’s manifesto was based on Holy Quran. There is a clear injunction in Holy Quran about drinking and there is no doubt about it.
As a scribe in a very popular daily, her writings mostly have a patriotic fervor. This scribe remembers one of her write ups, where she emphasized on her reason to move back to Pakistan, was due to the family values of East. Certainly, even if the bottles were a gift for a friend, it just puts a lot of question marks towards her conduct as a public figure.
The most striking issue of this whole episode is the prompt suo moto notice of our Supreme Court. It just makes you wonder, that the apex court has all the time in the world to focus on what would ordinarily be considered as “non issue.” Is it really that important is the key question.
One would at least assume that even if a law was broken or a statute of safety was violated, there may be lower courts to handle such incidences. Does it really beg the time of a three member bench to take an immediate notice?
There are many pressing issues ahead of the apex court. So much has transpired in Pakistan, ever since May 02, 2011 and the list is so long, that regurgitating the list would not do justice to so many items worthy of some prompt justice.
If anything it taints the credibility of the highest echelon of the justice system. Ms. Odho being Vice President (now former) of APML, was perhaps being viewed a bit closely. The reason for bad blood between the SC and Mr. Musharraf is common knowledge. This scribe’s personal opinion about Mr. Musharraf and his party are fairly well known at this forum. However, as a common man, I feel that it is perhaps not the most effective use of the valuable time of the apex court. This is a very respectful plea and hope that your Lordship (stealing the title from a very senior, and one of my favorite scribe, Ayaz Amir), would consider it.

iss mulk mein Chief Justice ki sunta kon hai. I think people are losing hope in courts now that nothing seems to happen over there and all the culprits in civilian and military establishment are getting away with everything most recent being murder of Saleem Shehzad allegedly by ISI. Now that is a case that should be worthy of suo moto but then you know what will happen to CJP.
In this way, at least CJP will get a chance to meet Atiqa Odho and reprimand her and probably she will take his advice.

This is a very srious issue as I concern because Ms.Odho is a public figure so the people in the society follow her and her brand and due to these types of issues there is bad impression given to society about celebrities and I think they should control themselves.

Dear Dr. Asghar,
In Quran there nothing about use or no use of liquor but said avoid “Khumar” (any substance which change your mindset). We even unclear and need Fatwa that what our law says about prohibited quantity of alcohol. I think our chief justice who was young advocate from Quetta had must experienced Whiskey but barely wine or bear having with low alcohol quantity. i am not a lawyer but i know that court can not trial a person for possession of alcohol. But if huge quantity of alcohol recovered than i will be assumed that person was trafficking alcohol for sale and that person would be charge under section 34 which is bailable charge.
Odho has not used alcohol or she was not called for medical test at that time.
We know our extra-independent judiciary is very patriarchal it had freed rapists in Mukhtara’s case and want to continue oppression against women. This court will soon mange to arrest, confiscate Asma Jehangir as alcohol user on instructions of their ISI patrons.
Having studied Arabic only for 3 years upto the level of Vernacular Final (Govt. Pilot School, Multan : Class of 1951) I am no expert (for a change from the usual) on this particular topic but any sherbet is sherraab in Arabic. It is not clear from these spinshots whether the friend Odho (whats her first name?) was carrying the two bottles for is nonMuslim former neighbour. Love Me Love my Wine is the vein of the day amongst our English-is-my-mothers-Leg variety.
Of course, Odho (she was quite attractive some sexteen years ago) should be prosecuted and punished if she broke the law with the necessary animus, and all that mattaz and jazz. The supreme Court taking notice suo motu is creditable albeit exception to the rule that it should en futuro concentrate on other more urgent and important tasks.

Yesterday, I was told by a mutual acquaintance from the One-Anna-Roti and Free-Daal Days that Hajji Mian Arshad Hasan KhanJee has wound up in LawWhore and richly migrated to the United $tates of America.
I have since early 1970′s fervently suggested a Truth and Recovery of Justice Commission to impartially investigate the shennanigans of pre-NNJP (pre 2009 judges, one and all) judiciary. That would be better use of the time of our Supreme Court.

Suo Motto is the legal obligation of apex court and so is the priority. Some actions and notices are taken to set a general trend and awareness for the respect of law and sense of in-discrimination in society. Such cases like of Atika Odho which are generally hushed up and covered up indiscriminately only because of social and political influence must be addressed. Why that Air hostess and so many other individuals were arrested and treated differently than Atika? Yes there are no doubt so many other cases occuring everywhere in our society that deem fit for suo-motto actions and notices but this particular case should not be ignored.
This CJ of SC is hungry of Cheap Popularity.
