RELIGIOUS LAWS IN PAKISTAN

The purpose of this article is to highlight the impact of the religious laws in Pakistan as they are being currently interpreted and implemented without going into the finer nuances of either the law or the religion. These laws come into limelight from time to time for brief periods only when a famous person is involved or if there are political implications. Once the issue disappears from the front pages of the news media the whole thing is forgotten. But the fact is that these laws affect ordinary citizens on a daily basis. I want to make the point that these laws, implemented without using common sense or taking the present day realities and the changing nature and circumstances of the crime, have become vehicles for promoting injustice, threats to the peace and harmony of the society, tools for political expediency, and suppression of critical thinking.
On promoting injustice: Qisas and Diyat laws are a prime example of this, being used to the detriment of the weaker members of the society that is women and the poor. Let’s first take the issue of women. Honor killings, disfigurement and mutilation of women by cutting of their body parts or throwing acid on them because someone’s “honor” is threatened are common occurrences. Under the above mentioned law it is the “wali” of the victim who is authorized to negotiate the terms of punishment with the murderer. He (since it is almost always a male) has the right to forgive the murderer and accept monetary compensation. But the irony is that in most cases, wali himself (or those closely related to him) is the murderer, being the husband, the father or the brother etc. Now does it make sense to have the murderer dictate the terms of his punishment? It is like investing the powers of the judge, jury and the executioner in the same person who is also the offender, giving him the right to make all the decisions. Is that the spirit of the Islamic law?
In the case of disfigurement and mutilation, the victim herself (since most of the time it a woman) should have the right to negotiate and agree to the terms of punishment. Has there ever been a court decision where a woman was authorized to throw acid on the face of the offender or cut off his nose as a punishment? If this is not a mockery of justice, what else is?
In fact an even more sinister aspect of this whole situation is that men, family or tribe have been granted the right to impose their will on women in the name of honor. This is the basis of honor crimes. That is why killing of a woman is justified because, “she deserved it” because she broke the so called moral and ethical code of the society. This assumption, this mind set, this atrocious behavior in the name of tradition, culture and religion is a horrifying aspect of “our values and norms” that we never tire of flaunting and praising, because these values make us better than those ‘immoral’ westerners. Really? There is a need to challenge this. What is honor and who defines it? Why do women have to give up their decision making powers, happiness, dignity, and freedom to save the so called honor of men, family, tribe etc. etc.? It has become honorable to kill and maim women and dishonorable to respect them, their bodies and their humanity. If this is not a skewed logic, what else is? And if this is not denigration of women, what else is? And we never tire of telling the world how Islam has elevated the status of women and how she has been protected!
Now let’s see how this law affects the poor. If the victim is poor and the offender rich, he/she not only has the financial wherewithal but in Pakistan also has the added political, social and legal clout to coerce the victim’s wali into accepting the monetary compensation instead of paying with his/her life for the perpetrated crime. But what if the victim is rich and the offender is poor? Do I have to explain what will happen? Religion which claims to bring economic and legal justice is in fact failing the poor on both accounts. Can there be any more atrocious consequences of a law? Can there be a law that is more discriminatory against the poor? If this is not a distortion of justice to the utmost, what else is? And if all of the above is not promoting injustice, what else is?
On threat to peace and harmony: Whenever a law is passed in the name of religion, it becomes nearly impossible to change or modify it even if subsequently it becomes apparent that it is being misused, has become a contrivance for aggression and is actually causing harm to the society by disturbing peace and tranquility. This is evident from the blasphemy laws as applied in Pakistan, which are being used to harass the religious minorities, for personal revenge, or for political motives. Even when the accused is not convicted by the court, he or she faces a constant threat to his or her life. At times people feel free to punish the alleged offender without due course of the law. The person is presumed guilty unless proven innocent rather than the other way around. Even minor and unintentional actions are interpreted in the harshest way possible thus leaving very little room for justice to be carried out fairly and impartially. Unfortunately this, like all other religious issues, has become a political tool to be used to inflame people’s emotions (which are, regrettably, highly inflammable). It has come to the point where even an utterance of unintended phrase, any discussion about the problems surrounding this issue, or any mention of further probing this legitimacy and authenticity of the law can cost one his or her life. If this is not disturbing peace and tranquility of the society, what else is?
As James Baldwin, a black American novelist and play writer and a leading voice in the civil rights movement, said, “If one really wishes to know how the justice is administered in a country, one does not question the policemen, the lawyers, the judges, or the protected members of the middle class. One goes to the unprotected—those, precisely, who need the law’s protection most! —and listens to their testimony.” So, the flag bearers of the religion, the rulers and the politicians, go and listen to the women, the religious minorities, and the poor and find out if justice is being administered in the Islamic Republic of Pakistan!
On use for political expediency: Since religious laws are amenable to different interpretations, they have a tendency to become tools in the hands of dictators, other autocrats and selfish political motives. Wasn’t the Qisas and Diyat ordinance of 1990 signed by Gen Zia for political expediency? Didn’t various political entities i.e. the government, the religious parties, and the army use and justify the Qisas and Diyat law to their own advantage during Raymond Davis fiasco? Aren’t there enough historical examples and cases where religion was used to support the decisions of the ruler rather than guiding it? Why do we refuse to learn from them? There always have been and always will be scholars who are willing to comply with the demands of the authority. The alliance of religion with the power will drown any dissenting voice. It has been so in all religions and Islam is no different.
On suppression of free thought: The last point I would like to make is that the danger lies not only in the specific laws but also the fact that when the word religion is attached to any law, rule or issue it immediately becomes off limits to any further discussion or debate among the very people whose lives will be affected by it. The doors of reason are closed. Questioning is not allowed. Any debate becomes a prisoner to rigid and fixed parameters set by the self proclaimed scholars, many of whom have vested interests and people are forced to suspend their intellectual faculties. And gradually it becomes their second nature to accept whatever edicts they are asked to follow.
Plato said, “Justice in the life and conduct of the state is possible only as first it resides in the hearts and souls of the citizens.” But when the hearts and souls of citizens have given up the quest for justice because an intellectual decay has set in due to suppression of free thought, is there still hope?

”The founder of the Sri Ram Sene Pramod Muttalik, who always likes to remain in the center of the controversy, has claimed that the arrested youths in the case of hoisting Pakistani flag were not members of his outfit. He claims that Sene does not have any students’ wing in the state points that the arrested person belonged to the Sangh Parivar.
Irrespective of the fact, whether it’s Sri Ram Sene or Shiv Sena or Bajrang Dal, that are behind such acts, the fact remains that these outfits have been guilty of creating communal divide in the country.
The political protection given to such outfits has emboldened them to commit such heinous crimes time and again.
The irony is the blame is put on the poor Muslims and when it comes to profiling they most bear the burnt of being vilified. There are stereotype that’s being dished out, such as: all Muslims are not terrorists but all terrorist are Muslims!
The likes of Sri Ram Sena or Shiv Sena or Bajrang Dal have a national immunity in such profiling because they have the benefit of doubt and they get away under the garb of patriotism.
A Hindu can never be a terrorist is an often hared cliché in India. The statement is rationalized by giving some hackneyed explanations. Hindus are vegetarians, they worship several gods, they are more god fearing etc, and other such theories that has become banal now.
Those who call Muslims ‘Babar ki Aulad’ are in fact sham creatures. They do so because they have deep rooted animosity against the Muslim that has come through the systematic act of brain washing. The anger, jealousy and hatred prompt them to do some mischievous acts. They do so in order to create a communal wedge in the society to keep Muslims on the back-foot all the time.”

The possibility that some Hindus may be behind the attempt to foist Pakistani flag is as horrifying as it is shameful. Nothing is more disgusting and more despicable than religious deception and religious fraud except the perpetration of religious deception and fraud accompanied with violence or intent to create violence.
If this story turns out to be true – and we have no reason to suspect its veracity – this won’t be the first case. Clearly, a segment of the Indian Hindu population based in Karnataka and perhaps parts of the north is going terribly wrong. What is going on? After all, kannadigas have traditionally been among the nicest and most tolerant people. Those of us who spend so much time offering advice to Pakistan may need to spend more time thinking about what may be afoot in India. In a way, it is odd that I am writing this on a Pakistani website

According to a breaking story in tonight’s Jerusalem Post, Israel’s state rabbinical authority has Häagen-Dazs ice cream, a popular US-made premium brand, is not kosher and that stores which sell the ice cream in defiance of the ruling face the revocation of their religious licenses as officials “clean” stores.
Interestingly, Häagen-Dazs itself was founded by Polish-Jewish immigrants to the United States, who used the Danish-sounding name as a marketing tool because they believed Danes to be associated with dairy products.
But the company, now a subsidiary of General Mills, has run afoul of Israeli rabbis over its use of liquid milk instead of milk powder, since many of the dairy farmers producing the milk are not Jewish and don’t have rabbis hanging out on their farms all the time supervising them.
This is an issue, the official notice warns, because “sages” have issued a ban on the consumption of non-Jewish farmers’ milk unless it was supervised, fearing that “it may be adulterated with milk from a non-kosher animal.”
Of course, non-kosher animal milk is not commonly used in the United States in the first place, with the only example being the relatively uncommon sale of camel milk, a much more expensive alternative to cow’s milk. Still, the threat that such milk may get snuck into Häagen-Dazs ice cream for some inscrutable reason threatens the company’s ability to continue selling its product in Israel.

Powdered milk from an unsupervised source is, however, permitted according to a ruling of Rabbi Tzvi Pesach Frank (1873–1960), a former chief rabbi of Jerusalem, who held that there is less of a suspicion that someone will go to the bother of adulterating powdered milk.

The latest in a long line of efforts at barring the nation’s Arab minority from public office came out of Israeli Foreign Minister Avigdor Lieberman’s party today, with a new bill that would bar anyone who wasn’t conscripted by the military from being in parliament.
In practice, this would oust the entire Israeli Arab community from parliament, as they are neither conscripted nor in large measure even allowed to serve in the military. It would also bar members of Israel’s Ultra Orthodox Jewish community from parliament, since they are likewise immune from conscription.

The terrorists attacking India are as evil in their chosen tactics as were Catholic terrorists in Ireland in 1920, Jewish terrorists in Palestine in 1948, or American terrorists in Oklahoma city in 1995.
But, as with those and most other terrorists, what drives the madmen who attacked India is a laundry list of wrongs and evils committed against those terrorists’ people. When there is such horror, and all reasonable ways of getting justice are exhausted, some small part of the victims will always turn to unreasonable ways.
Just as the British Empire committed many evils, earning it strife with Ireland, Palestine, and many others, so India (once fighting that very British Empire with terrorism) is an evil empire today, repressing and oppressing people within its own borders, plus occupying lands it illegitimately occupies, like Kashmir.

In 1947, India and Pakistan were being formed from the shambles of the British Empire. Each state of that region was supposed to choose which of the two countries to join.
When Kashmir’s ruler was slow to decide who to join, India attacked Kashmir, invading and occupying their land, robbing the 80% Muslim population from what was an almost inevitable decision to join Pakistan, or else declare independence.
When India persisted in occupying this region, preventing its union with Pakistan, the United Nations declared that it Kashmir should have an election, referred to as a “plebiscite”, in order to determine whether it joined India or Pakistan.
Since Kashmir is 80% Muslim, there was never any doubt which way the election would go…so “democratic” India has not, in the 60 years since, EVER allowed that election, continuing to illegitimately occupy Kashmir.
This was part of India’s very aggressive, violet habit at that time. For example, they also invaded and forcibly annexed the states of Junagadh and Hyderabad, one of which wanted to become Pakistani, the other wanting independence. India’s excuse was that both were majority Hindu…yet it ignores the fact that Kashmir is overwhelmingly Muslim.
People in Kashmir resist their country’s occupation, as any patriots should be expected to do.
When they do this against India’s troops, not only is it not “terrorism”, but it’s actually legal and legitimate, under international law, international humanitarian law, and Article 51 of the United Nations Charter. All people have a right to fight foreign occupation forces, not only a natural right, but even a legal one.
The repression and violence brought on by the extreme Indian military occupation, killing thousands of Kashmiri, ends up driving them to ever greater desperation. The Pakistani government takes advantage of this distress, funding militant movements because it wants the benefit of Kashmir as a territory, as illustrated by its opposition to Kashmir simply voting for its own independence.
Terrorism, in this situation, is almost inevitable. The war spills over from the Indian troops terrorizing the people of Kashmir, to Kashmiri terrorizing people in India. It’s not right, but it’s a natural result of the Indian government’s evil.
The same happened when Russia occupied Chechnya, the Soviets occupied Afghanistan…when you wrongfully occupy a people’s homeland, bringing them terror and suffering, eventually they bring it back to you.

Evidently the negative impact these Mirzai ‘floodings’ are creating on society are alarming and do not augur any better outcome for the Mirzai’s themselves.

People tend to elevate their religion as the one and only true belief system or faith. This absolute conviction of superiority over all other religions can be dangerous. Anyone who wants to really help muslims must criticize islam uncompromisingly. That is what muslims cannot do it themselves and hence non-muslims HAVE to do it for them. The flatterer is never the true friend. Islam is the root cause of the troubles of the muslims and the troubles which they cause to the non-muslims.
I try everything. It’s for future of humanity. I wish I got paid for rescuing Muslims from Islamic matrix. I have seen people get their senses back but it takes a ton of effort on both sides. Most are damaged beyond repair though. Children are the key. Muslim parents need to break the cycle.

Status of females in India:
The status of women is typically discussed on a nation-wide basis. However, about 80% of the citizens of India are Hindu, 14% are Muslim and 6% are of other religions or no religion. Most of the negative behavior towards girls and women across the country can probably be safely attributed to the practices of Hindus.
Infanticide has been widespread in India for centuries. R.J. Rummel reported:
“In India, for example, because of Hindu beliefs and the rigid caste system, young girls were murdered as a matter of course. When demographic statistics were first collected in the nineteenth century, it was discovered that in “some villages, no girl babies were found at all; in a total of thirty others, there were 343 boys to 54 girls. … [I]n Bombay, the number of girls alive in 1834 was 603.” 4
A Reuters article in 2007-JUL reported on the high level in India of:
bullet Female feticide: This is the practice of using ultrasound instruments to determine the sex of a fetus, in order to abort fetuses that are found to be female.
bullet Infanticide: This involves the actual murder of a newborn female, typically because of her gender.
bullet Widespread neglect of girl children.
bullet Mob violence, including murders, victimizing women believed to be evil sorcerers. 5

“A study of Tamil Nadu by the Community Service Guild of Madras … found that ‘female infanticide is rampant’ in the state, though only among Hindu (rather than Moslem or Christian) families. ‘Of the 1,250 families covered by the study, 740 had only one girl child and 249 agreed directly that they had done away with the unwanted girl child. More than 213 of the families had more than one male child whereas half the respondents had only one daughter.” 4,6
“Most strikingly, according to UNICEF, ‘A report from Bombay in 1984 on abortions after prenatal sex determination stated that 7,999 out of 8,000 of the aborted fetuses were females. Sex determination has become a lucrative business’.” 4,7
Using ultrasound techniques to determine the sex of a fetus with the intent of aborting it if it is female is illegal in India. However, the law is widely ignored because local officials are reluctant to fight the will of the people. 8
Reuters reports that:
“Around 10 million girls have been killed by their parents over the last 20 years, the government says, as female infanticide and foeticide, although illegal, are still prevalent with boys preferred to girls as breadwinners.” 5
Data on infanticide is quite unreliable. However, if we assume that the 10 million deaths is an accurate estimate and that the cases involved 98% feticide and 2% infanticide, then the three most serious instances of genocide over the past two decades may have been:
bullet The Rwandan genocide of about 800,000 persons based on tribal identity, and
bullet The religiously-based genocide of about 200,000 in Bosnia Herzegovina, involving mainly Serbian Orthodox Christians targeting Muslims, and
bullet The murder of 200,000 newborn girls in India.

“Domestic violence and sexual abuse involving young girls is reported frequently in the country and a 2006 government survey found that 45 percent of girls were married before the legal marriageable age of 18.”
“India’s adult female literacy rate was 47.8%, compared to the adult male rate of 73.4 percent in 2004.”
“The sex ratio in the country is still one of the world’s lowest, with an average of 933 females recorded for every 1,000 males in the 2001 census.”
” ‘Education of girls even in big cities was dismal and census figures show that the population of the girl child was dropping,’ said Chakraverti, adding that tough laws and education of parents were needed to force change. ‘Most cannot complete primary education’.” 5
Ipsita Roy Chakraverti, mentioned above, is a Wiccan and social activist. She has been nominated by the government’s National Commission for Minority Educational Institutions (NCMEI) to head a panel given the task of improving the status of young girls. 5
